best bicycle insurance
Simpler, more ecological, allowing regular physical activity: the bicycle has again become in a few years one of the favorite modes of transport of the French. This boom, facilitated by the appearance of self-service bicycle rental systems in many French cities, reminds us of the dangers inherent in it. If you are not obliged to be insured to ride a bicycle, whether electric or not, this can be very useful to you in the event of theft or an accident that you may suffer, but also cause to a third party .
How to be compensated in the event of a theft or breakage of a bicycle?
Whether it is for a classic bike or an electric bike, nothing obliges you to take out specific insurance. However, some risks are worth covering. This is particularly the case during a flight. In France, nearly 500,000 of these two-wheelers are stolen each year. It is therefore important to know who can compensate the cyclist who has been robbed.
In the case of the theft of a bicycle, electric or not, the cases differ depending on whether it took place in the home or outside. In fashion, bicycles are more and more sophisticated and do not attract covetousness at the same time. This is particularly the case with electric bicycles, which can be very expensive.
For a burglary that takes place in the insured accommodation or outbuildings, the bicycle can be compensated by the home insurance contract. If the bike is stolen outside, the MRH insurance will not compensate the cyclist. It is therefore necessary to take out a specific insurance contract that covers the bike. Many insurers now offer this product.
Additional specific insurance allows you to be compensated in the event of theft. However, it must have been attached to a fixed element using a lock. You should know that a large number of insurers imposing a lock that blocks the two wheels.
Bicycle insurance also intervenes if the cyclist was attacked during the theft.
Most bicycle insurance contracts have a few clauses to respect. These can be:
The theft must have been committed between 7 a.m. and 9 p.m.;
Only one compensated flight per year;
The bicycle must be purchased new and insured within 45 days of purchase;
The bike must be marked and registered with an association managing this marking.
For damage or a broken bike, the specific, complementary insurance can also intervene and compensate the cyclist.
What insurance in case of a bicycle accident?
In France, whoever causes damage is required to repair it. In concrete terms, if a cyclist is run over by a car, the driver's car insurance will cover the compensation, whether the cyclist's damage is bodily or material.
Please note, if the cyclist has committed an inexcusable fault, the sole cause of the accident, he will not be compensated. According to the website of the French Insurance Federation (FFA), an inexcusable fault is defined as "a willful fault of exceptional gravity exposing its author without valid reason to a danger of which he should have been aware". However, the latter is not opposable to "victims aged under 16, over 70 or holders, at the time of the accident, of a disability title at least equal to 80%", specifies the FFA.
In the event that the motorist is not insured, or if he commits a hit and run, the compensation is covered by the Mandatory Insurance Guarantee Fund (FGAO).
In another case, if the person responsible for the accident is none other than the cyclist himself, therefore falling alone, life accident guarantee insurance (GAV) can cover the loss as soon as this latter does not contain an exclusion on traffic accidents. For a child, school insurance can intervene. If the accident is minor, the participation of Social Security and complementary health may be sufficient. As far as material damage is concerned, the cyclist will only be compensated if he has taken out a specific insurance contract.
As for an accident with another cyclist or a pedestrian, if the latter are found responsible for the accident, it is their civil liability insurer who compensates the injured cyclist. GAV contracts can also provide additional compensation for bodily injury.
If the cyclist is himself responsible for an accident, the compensation of the victim will be your direct responsibility. It will then be his civil liability insurance contract, included in the MRH insurance, which will guarantee the bodily injury and material damage for which he is responsible.
MRH insurance can also intervene in the event of a conflict with a driver involved in the accident.
Are there any particularities for an electrically assisted bicycle?
The VAE is a classic bicycle equipped with a small removable electric motor. The autonomy of the motor is ensured by a rechargeable battery. The highway code does not precisely define the VAE. The latter is considered to be an assisted pedaling cycle, defined by decree no. 2009-497 of April 30, 2009. Furthermore, wearing a helmet is not compulsory on an electrically assisted bicycle, as on a conventional bicycle. Children under the age of 12 must wear one regardless of the type of bicycle driven.
Please note that the fast electric bike or speed bike is considered a moped. The difference with a VAE lies mainly in the speed of movement. For this type of bike, wearing a helmet is compulsory.
In terms of insurance, the VAE is like the classic bicycle. It is therefore possible to insure it. However, some insurers require that the electric bike meet three conditions:
A motor power not exceeding 250 watts;
The engine must cut off when 25 km/h is exceeded or when the cyclist brakes;
The motor only works when the cyclist is pedaling.
