Canadian employers often ask me questions about work permits in Canada. Indeed, it should be noted that conditions are attached to them. The main characteristics of a work permit for Canada are as follows:

 

Temporary

The work permit falls under the category of temporary residence. It is therefore issued to a foreign worker whose intention to stay in Canada is not permanent. The term "temporary" is not specifically defined in the law and, therefore, may be subject to interpretation. In practice, it is not uncommon for a foreign worker to come to Canada on a temporary basis (with a work permit) and then apply for permanent residence from Canada.

 

Specific employer

The work permit is, in most cases, specific to an employer. The foreign worker can therefore only work for the employer identified on the work permit. The working city is also identified on the permit and must be respected. Since the permit is specific to an employer, the foreign worker will have to obtain a new permit in the event of a change of job. The Canadian work permit is therefore not transferable from one employer to another.

 

Fixed period

The Canadian work permit can be valid for a period of a few weeks to a few years. The initial license term can be up to 3 years in some cases. The foreign worker will have to leave the territory of Canada when their permit expires, unless they have applied for a work permit extension in Canada. The expiry date is always indicated on the work permit.

 

Valid only for the exercise of a specific profession

The work permit in Canada is valid only for the practice of the occupation indicated on the permit. Thus, a foreign worker who has obtained a permit as a mechanical engineer will not be able to occupy the position of director of engineering services with this same permit! The occupation can be identified by referring to the National Occupational Classification designed by Human Resources and Skills Development Canada.

 

Multiple entry right

The work permit can be used by its holder to enter Canada as many times as he wishes during the duration of his permit. However, a visa may also be required for citizens of certain countries designated by Canada, including countries in Africa or Latin America.

 

No right to study

A work permit holder cannot study in Canada. In order to study, he must first obtain a study permit in accordance with the law.
